WHERE ARE FIRST-TIME DUI CHARGES TYPICALLY HEARD?

These cases are either heard in Phoenix Municipal Court or in one of the Maricopa County Justice Courts, located in Phoenix. Although these courts are not far away from each other, they are different jurisdictions with different prosecutors.

Phoenix Municipal Court has its own prosecutor’s office, but Maricopa County Attorney’s Office handles the Justice Courts. This is the same office that handles all the major cases in felony court. First-time DUI offenses can still be felonies, and these cases will be heard in Maricopa County Superior Court.

COURT PROCESS FOR FIRST-TIME DUI DEFENDANTS

Courts do not treat first-time defendants any differently, except that the minimum penalty is lower for a first offense than it is for a second or third. Judges may be open to giving the minimum sentencing for a first offense, but these penalties are still harsh.

A first conviction for DUI will require fines, classes, license suspension, and installation of an ignition interlock. As such, an experienced Phoenix attorney will often work to get the prosecutor to agree to a better outcome for a first-time DUI offense. The court will generally go along with what the prosecution and defense have agreed upon.

PENALTIES FOR A FIRST DUI CONVICTION IN PHOENIX

The penalties for a first-time misdemeanor DUI will dep end on the defendant’s blood alcohol concentration. Fines and fees can range from $2,000 to $4,500, with a higher BAC resulting in greater fines. A person convicted on first-time DUI charges may also face suspended driving privileges and required classes to have their license reinstated.

JAIL TIME FOR A FIRST DUI OFFENSE

A DUI conviction for a BAC above a 0.08 but below 0.15 may result in a minimum of ten days in jail. Nine of these may be suspended for complying with certain requirements.

A BAC of over 0.15 but below 0.20 may lead to 30 days in jail, nine of which are non-suspendable. In Phoenix Municipal Court, a defendant may be able to do two days in and seven days of an ankle monitor or home detention. However, options in County Court are more limited, and a defendant is unable to get work release.

If a defendant’s BAC was over 0.20, they may be looking at 45 days in jail for a first-time offense. The court can suspend all but 14 of those days. A savvy attorney at our firm could work to have three of the days in custody and the other 11 on an ankle monitor or home detention.
