Every allegation of wrongdoing that leads to criminal charges must be dealt with proactively and effectively. Even if the case is a mere misdemeanor, a conviction will create a criminal record and could see you serving jail time. You always have the right to fight the charges at trial. State law authorizes several diversion programs in Phoenix. If you fit the criteria and the prosecutor agrees to your entry, you may participate in these programs. WHAT IS A DIVERSION PROGRAM?
A diversion program is an alternative to criminal prosecution. It serves as a chance for a person to accept responsibility for their actions and learn from their mistakes. The main benefit is that completing these programs means a criminal court will dismiss the charges.
However, not everyone can enter a diversion program in Phoenix. Usually, they must fit within the guidelines for an already established program. Prominent examples include cases involving:

- When the defendant fits the definition of a youthful offender

ELIGIBILITY FOR PHOENIX DIVERSION PROGRAMS
Arizona Revised Statute § 11-365 allows the prosecutor bringing charges in the case to determine a person’s eligibility for a diversion program. These programs may also be referred to as deferred sentences and deferred prosecutions.
